HOW TO NOMINATE A SETTLEMENT AGENT

On the second page of your Offer and Acceptance at the base of the page there is an area highlighted as “CONVEYANCER” this is the box under buyer or seller where you can add your nomination of Settlement Agent and sign underneath.

From there the Real Estate Agent will forward either the original to the Buyers nominated Settlements Agent or a copy of the Offer to the Sellers Settlement Agent to enable them to start working on your file.

HOW SETTLEMENT PROCESS WORKS

BUYER

  • Contract for sale is fully completed and signed, settlement agent is nominate
  • Original contract is posted to the Settlement Agent
  • Contract is received by Settlement Agent and checked
  • Introduction letter and appointment to act is sent to the purchaser
  • Make an appointment with your bank manager / broker to obtain unconditional finance approval. They will need a copy of your contract for sale. You will need to inform this office how you are going to be paying the stamp duty.
  • Make an appointment with your bank manager / broker to obtain unconditional finance approval. They will need a copy of your contract for sale. You will need to inform this office how you are going to be paying the stamp duty.
  • You will also need to make an appointment with your bank manager / broker to sign your new mortgage documents. You may also need to provide a copy of your insurance to the bank.
  • If all conditions on the contract have been fulfilled then we can move forward to the settlement date i.e white ant inspection, building inspections etc
  • We will send you out further paperwork and settlement statements to be read, understood, signed and returned to this office as soon as possible.
  • You will also need to make an appointment with your bank manager / broker to sign your new mortgage documents. You may also need to provide a copy of your insurance to the bank
  • A stamp duty cheque is required prior to settlement, or you will need to organise with your bank manager / broker that the bank will release a cheque prior to settlement for us to collect, or that your first home owners grant needs to be approved with a unique identification number (UIN)
  • Once we have received your settlement documents and the bank is ready to settle the settlement will be booked in and you will be advised
  • Once settlement is completed you will be contacted and correspondence confirming that the settlement was completed and a financial statement will be sent out to you
  • A copy of the certificate of title in your name will be sent to you approximately 6 – 8 weeks after settlement. This issue can be fast tracked for a fee with Landgate (Department of Land and Information).

SELLER

  • Contract for sale is fully completed and signed, settlement agent is nominate
  • Copy of the contract sale is posted / faxed to Settlement agent
  • Contract is received by settlement agent and checked
  • Introduction letter and appointment to act is sent to seller
  • We will check and diarise that all conditions on the contract are dealt with
  • If you have any "Caveat’s or encumbrances" over the property they will need to be removed.
  • If you caveat’s over the property they will need to be removed
  • Once the contract becomes unconditional (all conditions on the contract have been met) we will then send you out further paperwork to be read, understood, signed and returned to the office.
  • Once the transfer of land document has been received from the other settlement agent it will be sent out to you for signing
  • Once all settlement documents and bank documents are completed and the bank is ready to book, we book settlements in at the purchaser’s bank
  • You will be contracted once settlement has been completed and correspondence to confirm settlement and a statement will be sent to you

WHAT DO YOU NEED TO DO IN THE SETTLEMENT PROCESS

Sign and return all settlement and bank documents in a prompt manner. If you have any questions contact this office as soon as possible.

SELLER

  • Contact your bank manager or broker to inform them you have sold your property and need to discharge your mortgage. If there is no mortgage and you hold the Certificate of Title then either hand deliver it to this office or send to this office via registered post so it can be tracked.
  • Make sure we have your forwarding address
  • Notify any other services you use at the property i.e Alinta, Wester Power, Telstra. They will need to liaise with you to do final readings / accounts.
  • Make sure you have all remotes, keys, alarm codes available for final inspection and hand over after settlement.
  • Enable the purchaser to do a final inspection on the property 5 business days prior to settlement
  • Cancel your insurance policies on the property i.e a few days after the settlement has been completed
  • Ensure the property is clean and all rubbish is removed from the premises
  • Handing over keys. If the property is your primary residence you don’t need to hand the keys over till 12.00 the day after settlement, if the property is not your primary residence then you can organise with your real estate agent to hand keys over once notification that the settlement has been completed
  • Redirect your mail or personally advise that you are changing address i.e. bank, electoral office, schools etc.

BUYER

  • Pay your deposit to the real estate agent
  • Organise unconditional finance approval by the date set out on the offer and acceptance, once received fax a copy to the real estate agent.
  • Inform us if you are going on holidays or are going to be un-contactable for an period of time during this settlement
  • Inform the settlement agent how you will be paying for the stamp duty or if you are a first home owner
  • Organise property insurance, your bank manager / broker may need a copy
  • Make an appointment with your bank manager / broker to sign your new mortgage documents as soon as possible. If you are a first home owner, make sure your bank manager / broker has completed the paperwork with you
  • Always confirm with us your settlement date before organising a removalist. Settlement date may not always happen on the settlement date due to many variables
  • If you need to add extra funds to the settlement balance, please deposit / transfer into our trust account at least 5 days prior to settlement. If you are transferring the funds from overseas, please note that the transfer can take up to a week and transfer fees will usually be taken out of those funds
